CALGARY WAKING UP TO ROT!
Calgarians are starting to see that the rotting pine is not restricted to central and northern Alberta.
The City of Calgary Assessment Review Board (ARB) has ruled in favour of the appeal made by a member of APSHA, and made a reduction to the assessment based on the rotting pine shake rooftop -
"... the Board is in agreement with the complainant that untreated pine shakes would affect the value of the subject if it were to be sold. This could not be considered to be normal maintenance, as the life span for wooden shakes is normally much more than ten years."
We've stated all along that the rotting shakes which are visible on the surface of the rooftop are only the tip of the iceberg. From our perspective, this action by the ARB is just one of many things which will eventually result in the awakening of Calgary homeowners to the true nature of the rot over their heads.
It's a shame that the media in the Calgary area have chosen NOT TO PUBLISH the factual documents we sent them last year. Maybe it's not too late for them to 'pick up the ball' on this story that affects tens of thousands of Albertans.

Government pays for replacement of rotting rooftop on Community Hall!
There appears to be a double standard out there. The information on this development comes to us courtesy of the Liberal Caucus, and it is provided here.

Government files Statement of Defence
The law firm of Lucas, Bowker and White has filed a Statement of Defence on behalf of the Province of Alberta denying all allegations, and challenging our right to pursue our case as a representative action.
As expected, it will be up to case management to decide the best manner in which to process thousands of similar claims in the Court. Our lawyers are prepared to defend our right to proceed with the representative action.

Statement of Claim has been 'served'.
Our lawsuit has now been 'served' against the Province of Alberta. The next steps depend on case management and any time limitations that they may place on each of the steps to be taken.

On the afternoon of June 4, 1999 APSHA filed a Statement of Claim in the Court of Queen's Bench against the Province of Alberta. The Statement currently specifies damages of $300 million. Click here for the Edmonton Journal's article on the subject.

Indications of problems in 1993

TREATED PINE PROBLEMS
On April 30th, Alberta Labour issued a Bulletin concerning treated pine shakes. You can read it here.
Our response to that information is contained in our April 30th Media Release, which you can read here. We believe this is really a case of the government trying to "cover their backside", and for homeowners, it's really a case of déjà vu!

Onward to Court of Queens Bench!
In early April we received our 'expert legal opinion' from the law firm of Parlee McLaws, and then spent some time reviewing it. As well, they provided us with a verbal presentation of their opinion in layman's terms.
We believe there is every reason to be optimistic about the merits of our case!
