TRIAL DATE NOW SET
The trial (on the issue of liability) has been placed on the February 2004 Civil Trial List.
More specifically, the trial will commence Monday, February 2nd, 2004 and run up to 24 days: to Friday, March 5th 2004.
APSHA will be proceeding with six sample cases.

Examinations for Discovery on the government officer, selected employees (and past employees, if retired), and our seven "sample cases" have been completed.
We are now awaiting the Court to set a date for the trial on the issue of liability.

An information meeting to deal with condominium issues was held on Tuesday, November 13th, 2001 in Edmonton.

Lawyers for the government filed a Third Party Notice in the (original) Court of Queen's Bench Action No. 9903 10452.
The Third Party is identified therein as Millar Western Industries Ltd., Millar Western Forest Products Ltd. and Majestic Forest Products Corporation.

INDIVIDUAL PLAINTIFF ACTIONS FILED AND SERVED
As of March 1, 2001, there have been about 3900 Individual Plaintiff actions filed and served on behalf of APSHA members.

Court Ruling re: Representative Action
May 29, 2000
The Case Management Judge decided that the action could not proceed as a 'representative action' for several reasons.

This is just a procedural issue; it does not make any ruling on the merits of the case.
In anticipation of having problems with the 'representative action', our lawyers were pre-authorized by over 2000 of our members to file Statements of Claim for 'individual plaintiff actions'.

Court Hearing re: Representative Action
May 23, 2000
The Case Management Judge, Mr. Justice Binder, heard both counsels present their arguments as to whether or not our claim should be allowed to proceed as a Representative Action.
The Judge reserved his decision after the presentations were completed.
